This User Agreement ("Agreement") governs your use of the Vissy application ("App"), a precision color extraction tool designed for designers, developers, and creative professionals. By downloading, installing, or using the App, you ("User" or "You") agree to be bound by all terms and conditions set forth below. If you do not agree to these terms, please do not use the App.
Vissy is developed to enable Users to extract accurate color information (including but not limited to RGB and HEX color values) directly from imported images through a simple tap interface. The App features an immersive full-screen design with a deep purple gradient theme, intuitive gesture controls for image scaling, panning, and manipulation, and comprehensive color management tools such as color bookmarks, color history tracking, and a floating color panel with one-click copy functionality. The App does not require account registration or login for access and use.
You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into this Agreement.
Subject to your compliance with this Agreement, the developer of Vissy ("Developer") grants you a non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal, non-commercial devices for the sole purpose of extracting color information and managing colors for your design projects (including website design, mobile application development, digital artwork creation, and other creative endeavors).
Any color data (including extracted color values, color bookmarks, and color history) generated through your use of the App is owned by you. The Developer does not claim ownership of such color data, but reserves the right to store this data locally on your device (in accordance with the Privacy Policy) to enable App functionality.
You may use the color data extracted via the App for any personal or commercial design projects, provided that such use complies with applicable laws and does not infringe the rights of third parties. The Developer is not responsible for the accuracy of color data in specific use cases (e.g., variations in display devices or printing processes) and recommends that you verify color accuracy for critical applications.
The Developer reserves the right to update, modify, or enhance the App (including adding or removing features, changing the user interface, or improving performance) at any time without prior notice to you. Such updates may be automatically installed on your device if you have enabled automatic updates, or may require your manual download and installation. You agree to accept such updates as part of your use of the App, as outdated versions may not function properly or may lack important security or functionality improvements.
Note: This section outlines the scope of the Developer’s liability in connection with your use of the App. It is intended to be clear and transparent, not to limit your legal rights where prohibited by applicable law.
The App is provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. The Developer does not warrant that the App will be error-free, uninterrupted, or free from viruses or other harmful components.
To the maximum extent permitted by applicable law, the Developer shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the App, including but not limited to damages resulting from: (a) errors or inaccuracies in color extraction; (b) loss of color data or bookmarks; (c) unauthorized access to your device or data; (d) interruptions in App functionality; or (e) use of the App with incompatible devices or software. This limitation applies regardless of whether the Developer has been advised of the possibility of such damages.
This Agreement shall remain in effect until terminated by either party. The Developer may terminate this Agreement and your license to use the App at any time if you violate any term of this Agreement. Upon termination, you shall immediately cease using the App and delete all copies of the App from your devices. The provisions of this Agreement that by their nature should survive termination (including but not limited to sections on liability, ownership, and governing law) shall continue to apply.
The Developer may update this Agreement from time to time to reflect changes in the App, legal requirements, or business practices. When changes are made, the Developer will post the revised Agreement within the App (e.g., in the "Terms" section) and update the effective date. Your continued use of the App after the posting of the revised Agreement constitutes your acceptance of the changes. We recommend that you review this Agreement periodically to stay informed of any updates.
